02The three checks
- Client confidentiality and personal data. Statements, credit files and transaction tables are full of identifiable clients. Contractual and common-law confidentiality apply as well as UK GDPR.
- Inside information. Deal records and research can hold material non-public information. Anything still price-sensitive stays out, and your compliance team should sign off the scope.
- Vendor data. Market data, ratings and research licensed from exchanges or vendors usually can't be passed on. Only data you created or own is yours to license.
Insurers: claims and underwriting files often include health information, which is special category data under UK GDPR. De-identify it properly or leave it out.
The FCA hasn't published rules on licensing data for AI training, but your existing obligations on confidentiality, data security and inside information apply. Involve compliance early.
03What a finance firm can realistically license
04Before you apply
- Separate data you own from data you license from vendors.
- Check NDAs and side letters with clients, portfolio companies and counterparties.
- Have compliance clear the scope for inside information.
- Ask each programme how it de-identifies transaction and client data.
This isn't legal advice.

The Data Licensing Guide for Finance and Insurance Firms covers it in a PDF for finance firms: what can be licensed, what confidentiality, inside information and vendor licences keep out, and each programme's published figures, with a worked example and the questions to ask before you sign.

07Questions people ask
Can an investment firm license its deal records?
Mercor's investment firm listing asks for closed-deal records, credit files and portfolio reporting. Check confidentiality agreements with portfolio companies and counterparties first, and remove personal data.
Can a hedge fund license market data?
Only data it owns. Market data licensed from exchanges or vendors usually comes with terms that bar redistribution. Mercor's listing asks for proprietary data, or the code that trades on it.
What about insurance claims?
Mercor names claims and underwriting files. Claims often hold health information, which is special category data under UK GDPR, so de-identify or leave it out.
Does the FCA have rules on this?
The FCA hasn't published rules on licensing data for AI training. Your existing obligations on client confidentiality, data security and handling inside information apply. Take compliance advice.
